Welcome to Gentle Rival, operated by Fixed Velocity LLC ("we," "our," or "us"). By accessing or using the Gentle Rival mobile application and related services (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. Features involving real money stakes are restricted to users who are 18 or older and located in jurisdictions where such activities are permitted.
To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at hello@gentlerival.com if you suspect unauthorized access.
Gentle Rival allows users to create and participate in fitness challenges with real money and/or points stakes. By participating in a challenge:
Gentle Rival operates as a skills-based competition platform. Challenge outcomes are determined by actual physical fitness performance verified through wearable device data, not by chance.
We charge a platform fee (currently 10%) on money-staked challenge payouts. This fee is deducted automatically before winnings are distributed. Fee amounts are disclosed before you confirm any stake. We reserve the right to modify fee structures with advance notice to users.
Payments are processed securely through Stripe. By adding funds to your wallet or staking money on challenges, you agree to Stripe's terms of service in addition to these Terms. Withdrawals are subject to identity verification and may take several business days to process. We reserve the right to delay or refuse withdrawals if we suspect fraudulent activity.
Points earned through the Service have no cash value and cannot be transferred between users. Points may be redeemed for rewards as available through the platform. We reserve the right to modify the points system, including earning rates, redemption values, and available rewards, at any time with notice to users.
The Service integrates with Apple HealthKit, Garmin Connect, and other fitness platforms to verify challenge completion. By connecting these services, you grant us permission to access the specific fitness data needed for challenge verification. This data is used solely for the purposes described in our Privacy Policy. We are not a healthcare provider and the Service does not provide medical advice.
Certain features of the Service may require a paid subscription. Subscription terms, pricing, and billing frequency are disclosed before purchase. Subscriptions auto-renew unless cancelled before the renewal date. You can manage and cancel subscriptions through your device's app store settings.

Violation of these rules may result in immediate account suspension, forfeiture of stakes and balances, and permanent ban from the Service.
All content, features, and functionality of the Service — including text, graphics, logos, icons, and software — are owned by Fixed Velocity LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the accuracy of fitness data provided by third-party devices or platforms. Participation in challenges involving real money stakes carries inherent financial risk.
To the maximum extent permitted by law, Fixed Velocity LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including loss of stakes, data, or profits. Our total liability shall not exceed the amount you have paid to us in the twelve months preceding the claim.
Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in New York, NY. You agree to waive your right to a jury trial and to participate in class action lawsuits.
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Any outstanding wallet balance (less any amounts owed for pending challenges or fees) will be returned to you within a reasonable timeframe.
